Welcome to Mailoverse. By accessing or using our Services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our platform.

1. Definitions

  • "Services" refers to the email testing platform, APIs, websites, and related tools provided by Mailoverse.
  • "Account" refers to your registered account that provides access to the Services.
  • "User" refers to any individual who accesses or uses the Services through an Account.
  • "Customer Data" refers to test emails, messages, and other content submitted to the Services.
  • "Subscription Plan" refers to the pricing tier and associated features you have selected.

2. Account Registration

To use our Services, you must create an Account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your Account information
  • Keep your password and API keys secure and confidential
  • Accept responsibility for all activities that occur under your Account
  • Notify us immediately of any unauthorized access to your Account

3. Use of Services

We grant you a limited, non-exclusive, non-transferable license to access and use the Services in accordance with these Terms. You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws
  • Transmit any harmful, threatening, abusive, or otherwise objectionable content
  • Attempt to gain unauthorized access to any part of the Services or related systems
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or disassemble any aspect of the Services
  • Use the Services to send unsolicited emails or spam to real users
  • Resell, sublicense, or redistribute the Services without authorization
  • Use the Services for production email delivery (Mailoverse is designed for testing purposes only)

4. Intended Use

Mailoverse is designed specifically for software testing purposes. The Services provide disposable email addresses and APIs for automated test scenarios. You acknowledge that the Services are not intended for production email delivery, personal email use, or any purpose other than software testing and development.

5. Subscription and Payment

Some features of our Services require a paid Subscription Plan:

  • Subscription Fees are billed in advance according to your selected plan (monthly or annually)
  • All fees are non-refundable except as expressly stated in these Terms
  • We may change our pricing with reasonable notice; price changes will take effect at the start of your next billing cycle
  • Failure to pay may result in suspension or termination of your access to the Services
  • You are responsible for all applicable taxes associated with your use of the Services

6. Free Trial

We may offer free trials or free tiers of our Services. Free offerings are provided "as-is" and may have limited features or usage quotas. We reserve the right to modify, limit, or discontinue free offerings at any time without notice.

7. Customer Data

You retain ownership of all Customer Data you submit to the Services. By using the Services, you grant us a limited license to process Customer Data solely for the purpose of providing the Services. You are responsible for:

  • Ensuring you have the right to use and submit all Customer Data
  • The legality, accuracy, and appropriateness of Customer Data
  • Using test data rather than real personal information whenever possible
  • Complying with all applicable data protection laws

8. Intellectual Property

The Services, including all content, features, and functionality, are owned by Mailoverse and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Services except for the limited license to use the Services as described herein.

9. Service Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted access. We may temporarily suspend the Services for maintenance, updates, or other operational reasons. We will endeavor to provide advance notice of planned maintenance when possible.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Services are provided "as-is" without warranties of any kind, express or implied
  • We do not warrant that the Services will be error-free, secure, or uninterrupted
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Mailoverse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

Either party may terminate the agreement:

  • You may cancel your Subscription at any time through your Account settings
  • We may suspend or terminate your access if you violate these Terms
  • We may terminate free accounts after extended periods of inactivity
  • Upon termination, your right to access the Services will cease immediately
  • Customer Data may be deleted after account termination in accordance with our data retention policies

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through the appropriate legal channels.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
